On February 21, 1967, Mrs. Peggy I. Krenz was injured in a fall down a flight of stairs located on the premises owned by William C. Laing and leased by Edward R. Schultz. She suffered a comminuted fracture of the right ankle, for which she was treated by Dr. David J. Sievers. In January of 1969, Mrs. Krenz and her husband Norman commenced a suit against Laing and Schultz and a year later in January of 1970, commenced this suit for malpractice against Dr. David J. Sievers and his insurer Medical Protective Company of Fort Wayne, Indiana.
